An uncontested divorce offers a more streamlined and cooperative path for couples seeking to finalize their separation in Ontario.
What is s Uncontested Divorce?
A divorce is considered uncontested when both partners agree on all significant matters concerning their separation, or when one partner fails to respond to the divorce petition. In contrast to a contested divorce, there are no disagreements for the court to address. A divorce is uncontested if:
- Both partners approve a separation agreement that addresses property distribution, child support, spousal support, and parenting plans; or
- One partner initiates the divorce, while the other does not submit an “Answer” contesting the allegations
The Unccontested Divorce Process in Ontario:
Uncontested divorces usually take less time and are less expensive than contested divorces. The typical process generally involves:
- Filling the Application – The Applicant submits a divorce application (Form 8A- simple divorce or Form 8- Joint Divorce).
- Service – If it’s not a joint application, the applicant is required to serve the other spouse with the documents.
- Response Period – If the other spouse fails to challenge the application within the specified period (30 days in Canada), the divorce advances uncontested.
- Submitting Evidence and Paperwork – Financial statements, marriage license, and any required affidavits are submitted.
- Judge’s Review – A judge examines the paperwork to confirm compliance with legal standards and that provisions for children are appropriate.
- Divorce order granted – If all is correct, the judge endorses the divorce decree. The divorce is finalized following a 31-day waiting period.

- Negotiate a Separation agreement – Address all matters before submitting the divorce petition.
